These Terms & Conditions apply when you use Folkster.com or purchase goods from Folkster.

We have tried to keep them as clear and straightforward as possible. Nothing in these Terms & Conditions limits your statutory consumer rights.

Throughout these terms, "Folkster", "we", "us" and "our" refer to Folkster Limited.

USING FOLKSTER.COM

By using Folkster.com, you agree to use the website lawfully and not to:

Interfere with the operation or security of the website
Attempt to gain unauthorised access to any part of the website
Copy or commercially exploit Folkster content without permission
Use automated systems to scrape, download or reproduce Folkster content or imagery
Use Folkster.com for fraudulent or unlawful purposes

We may update, change or temporarily suspend parts of Folkster.com where reasonably necessary.

PLACING AN ORDER

When you place an order through Folkster.com, you are offering to purchase the products in your order subject to these Terms & Conditions.

You will normally receive an email confirming that we have received your order.

Receipt of an order confirmation does not necessarily mean that we have accepted the order.

An order is accepted when we confirm that it has been dispatched or, where applicable, is ready for collection.

We reserve the right to decline or cancel an order before dispatch where there is a legitimate reason to do so, including:

An item is unavailable
There has been an obvious pricing or website error
We cannot authorise or verify payment
We reasonably suspect fraud
Delivery is not available to the address provided
We reasonably believe an order has been placed for unauthorised commercial rental, hire or resale purposes
An unusually large quantity has been ordered and we need to verify that it is a genuine personal or bridal-party purchase

If we cancel an order after payment has been taken, the appropriate amount will be refunded.

PRODUCT INFORMATION

We put a huge amount of care into showing our products as accurately as possible.

However, colours can look slightly different depending on your screen, device, lighting and display settings.

There can also occasionally be small variations between production batches, particularly in fabric shades, texture, embellishment or handmade details.

Measurements and sizing information are intended as a guide.

Our team is always happy to help with sizing before you order, but ultimately the customer is responsible for choosing the size ordered unless we have specifically agreed otherwise.

PRICING

Prices are displayed on Folkster.com in the currency selected or made available to you.

Folkster's base currency is Euro (€).

Prices and promotions may change from time to time.

A price displayed on a particular day does not guarantee that the same price will apply at a later date.

If we discover an obvious pricing error after an order has been placed, we will contact you before dispatch where reasonably possible.

We will not knowingly charge a customer an incorrect higher price without their agreement.

PAYMENT

Payment must be made using one of the payment methods offered at checkout.

Your payment provider may carry out additional security or verification checks.

Where payment is displayed or processed in a currency other than Euro, exchange rates and any charges applied by your bank, card provider or payment service are outside Folkster's control.

STOCK AVAILABILITY

All products are subject to availability.

An item appearing on Folkster.com does not guarantee that it will remain available until checkout has been completed and the order accepted.

Very occasionally, stock discrepancies can occur. If an item you ordered is unavailable, we'll contact you and arrange the appropriate refund or alternative where agreed with you.

PRE-ORDERS & MADE-TO-ORDER ITEMS

Some Folkster products may be offered on a pre-order or made-to-order basis.

Estimated arrival or delivery dates are estimates rather than guaranteed dates unless we expressly state otherwise.

Production, freight, customs or other circumstances can occasionally affect expected arrival times.

Where an item is genuinely made to your individual specifications or clearly personalised for you, statutory change-of-mind cancellation rights may not apply.

Where this is the case, it will be made clear before you place the order.

The fact that an item is described simply as a "pre-order" does not by itself remove any statutory consumer rights that apply to the purchase.

SHIPPING & DELIVERY

We ship within Ireland and internationally to many destinations.

Shipping rates, estimated delivery times, customs information and other delivery details are available in our Shipping & Delivery Policy.

Please make sure the shipping address supplied with your order is complete and correct.

If a parcel is returned to Folkster because an incorrect or incomplete address was supplied or delivery or collection was not completed after the carrier's attempts, reasonable re-delivery costs may apply.

Folkster remains responsible for delivery in accordance with your applicable statutory consumer rights.

CUSTOMS & IMPORT CHARGES

Orders shipped outside the EU may be subject to customs duties, import VAT, taxes or carrier charges imposed by the destination country.

Unless specifically collected at checkout, these charges are not set or collected by Folkster and are generally the responsibility of the customer.

RETURNS & REFUNDS

Our current Returns Policy forms part of these Terms & Conditions.

Eligible online returns must be notified to Folkster within 14 days of delivery, in accordance with your statutory rights.

Different change-of-mind policies may apply to purchases made in-store.

Certain products may also be excluded from change-of-mind returns where permitted by law.

Nothing in these Terms & Conditions or our Returns Policy limits your statutory consumer rights.

FAULTY ITEMS

If you believe an item is faulty, please contact hello@folkster.com and provide details of the issue where possible.

Returning an item and describing it as faulty does not automatically mean Folkster has accepted that the item is faulty.

We may inspect the product to assess the issue, including whether it appears to result from a manufacturing defect, normal wear and tear, accidental damage, misuse or another cause.

Where goods are confirmed to be faulty or otherwise not in conformity with your consumer rights, the appropriate remedy will be provided in accordance with applicable law.

Depending on the circumstances, this may include a repair, replacement, price reduction or refund.

LARGE ORDERS & COMMERCIAL PURCHASING

Folkster products are primarily offered to individual customers for personal use, including brides, bridesmaids and bridal parties.

We reserve the right to review unusually large or repeated orders where we reasonably believe that products are being purchased for commercial rental, hire or unauthorised resale rather than personal use.

Where this is identified before an order is accepted or dispatched, we may decline or cancel the order and refund any applicable payment.

If you're ordering for a large bridal party, don't worry! Large genuine customer orders are very welcome.

COMMERCIAL RENTAL, HIRE & RESALE

Folkster does not authorise commercial dress rental, dress hire or resale businesses simply because they have purchased a Folkster product.

A business possessing a genuine Folkster product does not mean that the business is:

An authorised Folkster retailer
An approved Folkster rental or hire partner
Affiliated with Folkster
Endorsed by Folkster
Permitted to use Folkster's photography, imagery, branding or other copyrighted material

Commercial businesses must not represent or imply that they have an official relationship with Folkster where no such relationship exists.

Nothing in this section is intended to restrict any rights a person may have under applicable law in relation to a genuine product they lawfully own.

FOLKSTER PHOTOGRAPHY, IMAGERY & COPYRIGHT

Our photography and imagery are a huge part of Folkster, and a lot of creativity, work and investment goes into creating them.

All original Folkster photography, campaign imagery, product imagery, graphics, website copy, videos and other creative material owned by Folkster are protected by copyright and other applicable intellectual property laws.

Unless we have given prior written permission, Folkster content may not be:

Copied
Downloaded for commercial use
Reproduced
Republished
Altered
Distributed
Used in advertising
Used on another commercial website
Used on a commercial social media account
Used on a marketplace or rental platform

In particular, Folkster photography, product imagery and campaign imagery may not be used by dress rental, dress hire, resale or other commercial businesses to advertise or promote Folkster products without our express written permission.

Purchasing or otherwise acquiring a Folkster product does not transfer any copyright in Folkster photography, imagery, graphics or creative content.

FOLKSTER NAME & BRANDING

The Folkster name, logos, branding, graphics and other brand identifiers are valuable parts of our business.

They may not be used in a way that falsely suggests an affiliation, partnership, sponsorship or endorsement by Folkster.

In particular, third-party businesses must not present themselves as an "official", "authorised", "approved" or "partner" Folkster retailer, rental business or stockist unless Folkster has expressly agreed this in writing.

Fair and lawful references to genuine Folkster products are not prohibited by this clause.

CUSTOMER REVIEWS & CONTENT

We LOVE seeing our customers in Folkster :)

If you tag Folkster, send us photographs or other content, or use a Folkster hashtag, this does not automatically transfer ownership of your content to us.

If we would like to use customer-created content for advertising or another significant commercial purpose, we may contact you for permission where appropriate.

Please only send or upload material that you have the right to share. :)

WEBSITE LINKS

Folkster.com may contain links to websites operated by third parties.

We don't control those websites and aren't responsible for their content, privacy practices or services.

We recommend checking the relevant terms and privacy information when visiting another website.

PRIVACY

How we collect and use personal information is explained in our Privacy & Cookies Policy.

By using Folkster.com, your personal information will be handled in accordance with that policy and applicable data protection law.

EVENTS OUTSIDE OUR REASONABLE CONTROL

Sometimes circumstances outside our reasonable control can affect our ability to fulfil an order or provide a service as originally expected.

These may include severe weather, transport disruption, customs delays, strikes, supplier disruption, natural disasters, government restrictions or widespread systems failures.

Where this happens, we'll do our best to minimise the impact and keep affected customers informed.

Nothing in this section limits any rights you have under applicable consumer law.

LIMITATION OF LIABILITY

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

Nothing in these terms limits Folkster's obligations in relation to faulty goods, statutory consumer rights, fraud, personal injury caused by negligence or any other liability that cannot lawfully be excluded.

To the extent permitted by law, Folkster is not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made by a consumer for personal purposes.

CHANGES TO THESE TERMS

We may update these Terms & Conditions from time to time, for example where our business, website, services or legal obligations change.

The terms applicable to your purchase will normally be those in effect when your contract with Folkster was formed.

The latest version will always be available on Folkster.com.

GOVERNING LAW

These Terms & Conditions are governed by Irish law.

If you are a consumer living elsewhere, nothing in these terms deprives you of any mandatory consumer protections you are entitled to under the laws applicable to you.

Any dispute may be brought before the courts with jurisdiction under applicable law.
